TravelBinder Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the TravelBinder application, website, API, and related services (collectively, the "Service"). By creating an account, installing the app, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
TravelBinder provides a travel information organization service that enables you to consolidate and organize your travel information into structured itinerary data. The Service includes features such as trip management, itinerary organization, checklists (Packing Lists and To-Do Lists), required arrangements tracking, and related travel planning tools. The Service may send push notifications and provide read-only offline access. The Service has functionality and availability that may evolve over time.
2. Eligibility
You must be at least 13 years old to use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
3. Your Account and Security
- Authentication uses an email magic link sign-in flow. You are responsible for maintaining control of your email account and device.
- You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
- We may suspend or terminate accounts for suspected abuse, security concerns, or violations of these Terms.
- Email and password changes require confirmation through time-limited links sent to your addresses. You must safeguard access to your email accounts to prevent unauthorized changes.
4. Acceptable Use
- Use the Service only for lawful purposes and in accordance with these Terms.
- Do not upload or forward content that you do not have the right to process or share.
- Do not reverse engineer, interfere with, or disrupt the Service or its infrastructure.
- Do not attempt to access data belonging to other users.
- Do not use the Service to transmit malware, spam, or harmful code.
5. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.
6. User Content and License
- "User Content" means emails, files, and other materials you submit to or through the Service, the itinerary data derived from such materials, and any content you create directly in the app (such as checklists, checklist items, required arrangements, notes, and trip attachments including manually uploaded PDFs and images).
- You retain ownership of your User Content. You grant TravelBinder a worldwide, non-exclusive, royalty-free license to host, store, process, transform, and display your User Content solely to provide and improve the Service.
- You represent and warrant that you have all rights to submit the User Content and to grant the above license.
7. Data Residency and Security
- We target U.S.-only data residency for storage and processing using Microsoft Azure services, as described in the Privacy Policy and Technical Requirements.
- We use TLS in transit and encryption at rest for supported services, and implement isolation via application and database controls. No system can be completely secure; you use the Service at your own risk.
8. Retention and Deletion
- We retain raw emails, files, and derived data to support parsing, auditability, and app functionality.
- You may delete trips/items in-app. You may request account deletion per our Privacy Policy; deletions are permanent and cannot be undone.
9. Third-Party Services
We use third-party providers (e.g., Postmark, Azure, Firebase, OpenAI, Sentry/App Insights) to deliver the Service. These providers act on our behalf under appropriate safeguards. Use of the Service constitutes your consent to such subprocessing.
10. Beta Features and Changes
- Features may be released as beta or experimental and may not function as intended.
- We may modify or discontinue features at any time, with or without notice.
11. Prohibited Sensitive Data
Do not submit highly sensitive personal information (e.g., Social Security numbers, full payment card numbers, or protected health information). The Service is not designed to process such data.
12. Intellectual Property
- The Service, including software, design, logos, and content (excluding your User Content), is owned by TravelBinder and its licensors and is protected by intellectual property laws.
- Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.
13. Feedback
If you provide feedback or suggestions, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use and incorporate it without restriction. When you submit feedback through the app, we collect device information (such as device type, operating system version, device model, app version, screen dimensions, locale, timezone, and network type) to help us diagnose and address issues. This information is stored securely and used solely for support and debugging purposes.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that data will be accurate or complete. Travel information may contain errors; always verify with your providers.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRAVELBINDER OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
16. Indemnification
You agree to defend, indemnify, and hold harmless TravelBinder and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your User Content; or (c) your violation of these Terms or applicable law.
17. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, Sections 6 (User Content and License), 12–16, and 19–21 will survive.
18. Communications
We may send you service announcements, administrative messages, and notices (e.g., regarding changes to these Terms or the Privacy Policy). You may control non-essential notifications as described in the app or OS settings.
19. Governing Law; Venue
These Terms are governed by the laws of the State of Washington and the United States, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington for any disputes arising from or relating to these Terms or the Service.
20. Arbitration and Class Action Waiver (Optional)
To the extent permitted by law, you and TravelBinder agree that any disputes will be resolved through binding arbitration on an individual basis, and not as a class, consolidated, or representative action. If this clause is not enforceable as to a particular claim, then Section 19 (Governing Law; Venue) will apply to that claim in court. This Section does not apply to claims where injunctive or other equitable relief is sought to prevent unauthorized use or abuse of the Service or infringement of intellectual property rights.
21. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above will reflect the most recent changes. If changes are material, we will provide reasonable notice (e.g., in-app message or email). By continuing to use the Service after changes become effective, you agree to the revised Terms.
